B. TERMS AND CONDITIONS OF LEASE

1. Lease of Short Term Accommodation

These Terms and Conditions of Lease govern the letting of premises ("P remises" ) by the
Company to you via the Website. The Terms and Conditions of Sale are in addition
to the terms and conditions of use of the Website, which can be viewed at
SHORTSTAY .

Once you tick the box labelled "I accept", these Terms and Conditions of Lease form a
legallybinding agreement between you and the Company. You may contact us via
email at SHORTSTAY to obtain a full record of your transaction. We will in any event
confirm all your reservations with you via email.

2. Payment

Payment can be made via the Website by credit card? 
direct bank deposit or electronic funds transfer, in which event, you must make
payment within 5 days of placing your booking, and the Company will not
execute the booking until receiving confirmation that payment has been
received?

Credit Card Transactions are acquired by MyGate Communications (Pty) Ltd, a
registered systems operator and payment gateway in South Africa. Card
Holders may go to www.mygate.co.za to view MyGate’s security policy?
Once you accept these Terms and Conditions of Lease, you will be directed to a link
to a secure site for payment of the service.

3. PRIVACY

We take the security of your payment and personal information seriously. In this regard, you
will be provided with a security certificate once you accept these terms and
conditions of sale. All personal information that you provide to us is subject to our
Privacy Policy. However, due to the nature of the Internet, we cannot guarantee that your communications
will be free from unauthorised access by third parties. Accordingly, WE WILL NOT
BE LIABLE FOR ANY LOSS OR DAMAGES ARISING FROM THIRD PARTIES'
UNAUTHORISED ACCESS OF YOUR DATA .

4. Cancellation and Refund

The cancellation policy is contained in the Short Term Lease Agreement which may be
viewed on our Booking Forms as part of our Terms & Conditions.

5. Breach

If any party ("Defaulting Party" ) breaches any of these terms and conditions and fails to
remedy such breach within 24 (twenty four) hours of receipt of notice to remedy the
breach, the aggrieved party shall be entitled to claim specific performance or to
cancel this agreement forthwith upon written notice to the defaulting party, without
prejudice to its right to recover:
any amounts that may be due to it in terms of this agreement? and
any loss or damage suffered as a consequence of the breach or the cancellation of
this agreement.

6. Governing law and jurisdiction

Our relationship and/or any dispute arising from or in connection with these terms and
conditions of sale shall be governed by the laws of the Republic of South Africa. You agree to
be subject to the exclusive jurisdiction of the South African courts.

7. NOTICES

The Company hereby selects: High Constantia House, Cnr. Main & Groot Constantia Road,
Constantia, 7806 as its address for the service of all formal notices and legal
processes in connection with these terms and conditions of sale ("d omicilium " ). You
hereby select the address specified on the booking form as your d omicilium. Either
party may change its d omicilium to any other physical address by not less than 7
days' notice in writing to the other party. Notices must be sent either by hand,
prepaid registered post, or email and must be in English. All notices sent –
by hand will be deemed to have been received on the date of delivery?
by prepaid registered post, will be deemed to have been received 10 days after the
date of posting? by email will be deemed to have been on the date indicated in the "Read Receipt"
notification. A LL EMAIL COMMUNICATIONS BETWEEN YOU AND US
MUST MAKE USE OF THE "READ RECEIPT" FUNCTION to serve as
proof that an email has been received.

8. General

You may not cede, assign or otherwise transfer your rights and obligations in terms of these
terms and conditions of sale to any third party.

Any failure on the part of you or the Company to enforce any right in terms hereof shall not
constitute a waiver of that right.

If any term or condition contained herein is declared invalid, the remaining terms and
conditions will remain in full force and effect.

No variation, addition, deletion, or agreed cancellation of these terms and conditions will be of
any force or effect unless in writing and accepted by or on behalf of the parties
hereto.

No indulgence, extension of time, relaxation or latitude which any party ("t he g rantor" ) may
show grant or allow to the other ("the grantee" ) shall constitute a waiver by the
grantor of any of the grantor's rights and the grantor shall not thereby be prejudiced
or stopped from exercising any of its rights against the grantee which may have
arisen in the past or which might arise in the future.

These terms and conditions of sale, read together with the Terms and Conditions of Use of
the Website and our Privacy Policy contain the whole agreement between you and
the Company and no other warranty or undertaking is valid, unless contained in this
document between the parties.

South African legislation which includes the Electronic Communications and
Transactions Act, No. 25 of 2002 as amended.

soon as it is no longer accurate and complete.

enforce our rights as set out in these TERMS AND CONDITIONS and conduct
market research. The additional information provided assists us in personalising your
browsing experience whilst the third party information allows us to deliver products to
such parties and to contact them to ensure delivery.

without your express consent. We will not use or disclose your personal information

Due to organizational and operational purposes we have appointed certain entities that will
assist process personal information for purposes strictly connected to the
performance of services on the Website which includes the making of reservations.

The abovementioned processors have been chosen because of their experience in

compliance with data processing laws (including the technical security measures
governing the processing to be carried out). In processing the personal information,
the processors shall act only on instructions from us. We regularly check that our
processors comply with our instructions and that they continue to provide sufficient

on your booking form only for the purpose reserving the booking made by you.

be stored in a way which allows us to identify you for the period necessary for the
purposes which the information was collected for and subsequently processed and,
in any case, in accordance with applicable law.

ensure that your personal information is always accurate and uptodate,
relevant and complete. Your personal information shall not be disclosed to third parties for
purposes, which are not permitted by law or without your explicit consent.
Apart from the entities appointed for personal information processing, your personal
information will also be made available to third parties and autonomous controllers
for purposes related to supplying services requested by yourself (for example for
payment) or for other purposes provided that your specific consent having been
obtained for that purpose. For more information on the matter we refer you to section
7 of this Privacy Policy. Your personal information may be disclosed to the police or
to judicial authorities according to law and upon a formal request by such entities.
Your personal information will not be transferred abroad to countries that do not
ensure an adequate level of protection of personal information. Should this be
necessary in order to supply services or to execute a contract for the making
of a reservation, your personal information shall be transferred to such nonSA
countries only after the execution of specific contracts between Seeff and such
entities in accordance with applicable law and regulations.

The reasons for collecting personal information will be expressly listed in the privacy policy
statement presented on the page of the Website asking you to provide such personal
information.

In all of the above cases, please make sure you receive the consent of such individual before
disclosing their personal information to us and make sure you inform them about this
Privacy Policy? you will be the only person liable in connection with the disclosure of
information and data regarding such third parties if they have not provided you with
their express consent for it and for any improper and unlawful use of that information.
In any event, we shall fulfil any obligation to inform such third parties required by law
and, when necessary, shall request their express consent upon registering in its

Granting your personal information to us (in particular, your personal details, your email
address, your address and your telephone number) is necessary for processing your
reservation on the Website, supplying other services provided on the web site upon
your request, or when your personal information is needed to fulfill obligations
required by law or regulations.

The refusal to provide us with some of your personal information necessary for performing
the above purposes may consequently prevent us from processing your reservation
on the Website or fulfilling obligations required by law and other regulations.
Therefore, failing to provide personal information may constitute, in some cases, a
legitimate and justified reason for not processing your reserving on the Website.
Disclosure of further personal information to us other than that required for fulfilling legal or
contractual obligations is, on the contrary, optional and does not have any effect on

without informing our users of such disclosure/dissemination/transfer, without their
consent and, in any case, in accordance with the law.
